Family immigration is the most common form of permanent immigration to the United States. It includes spouses of U.S. Citizens and Lawful Permanent Residents, parents petitioned by adult U.S. Citizens, children of every age, and brothers and sisters. The key to any family petition is meeting every requirement and confirming the beneficiary is not inadmissible. A family-based visa is any visa based on a family relationship. The categories you can file in depend on whether the petitioner is a U.S. Citizen or a Lawful Permanent Resident.

Marriage to a U.S. Citizen while inside the United States.

If a foreign citizen marries an American while in the U.S. legally, the U.S. spouse can petition through adjustment of status , a one-step process that files for either conditional or permanent residency at once. This is the most common type of case we handle.

Married more than two years at the time of approval, permanent status is granted. Less than two years , conditional status is granted, and a removal of conditions case must be filed 21 to 24 months later.

When the marriage happens abroad.

When an American Citizen marries a foreign national outside the U.S., the process can be tougher, especially after a long-distance dating period with no shared cohabitation.

In those situations we often recommend a fiancé visa over a spouse visa, because its requirements are easier to prove. If the marriage has already taken place and a fiancé visa is no longer an option, there are concrete steps a couple can take to satisfy the bona fide marriage requirement for USCIS and the U.S. Department of State.

When a Permanent Resident marries a sweetheart abroad.

Many Lawful Permanent Residents marry their partners from their home countries after obtaining residency. The couple can marry, but expect a wait time of up to three years.

During the wait, the foreign spouse generally cannot obtain any U.S. visa that is not dual intent, because they're considered an intending immigrant. There is an active proposal to move LPR spouses into the same immediate-relative category as spouses of U.S. Citizens; until the law changes, waiting is the only option.
