Many non-citizens come into the custody of Immigration and Customs Enforcement (ICE). ICE first decides whether you are eligible for an immigration bond, and how much. By statute the minimum bond is $1,500, but in Las Vegas ICE often sets a much higher amount.

If the bond is too expensive, the next step is a bond reduction hearing before the U.S. Immigration Court. As your attorney, I'll ask the judge to lower the bond so the detainee can be released.

If ICE refuses to set a bond at all, and the person isn't subject to mandatory detention, we request an initial bond hearing for a re-determination. An Immigration Judge may grant a bond, though figures over $10,000 are not unusual. If your relative, friend, or employee is detained, contact us right away.

Defenses Against Removal

There are two primary defenses against deportation: cancellation of removal and adjustment of status. Cancellation cancels the removal order and allows the person to remain in the United States as a Permanent Resident.

Permanent Residents may use this defense with seven years of total U.S. residence in any status and five years as a Permanent Resident.

Non-Permanent Residents may qualify with ten years of continuous presence, good moral character, no disqualifying convictions, and proof that a U.S. Citizen or LPR spouse, parent, or child would suffer exceptional and extremely unusual hardship if they were deported.

Adjustment of Status, based on a family or employment petition, can make you a Permanent or Conditional Resident. In some cases, current LPRs whose offense is deportable but not inadmissible can readjust their status. Other forms of relief include Asylum and Withholding of Removal.

  • 7 years total U.S. residence in any status

How do I know if I am in danger of being deported?

If a foreign national entered the U.S. without a visa, overstayed a visa, or has an expired work visa, they're at risk. Immigration authorities tend to prioritize those who have overstayed visas, and any foreign national who has committed a crime, especially a felony, has the highest risk of deportation.

What is withholding of removal?

Withholding of removal pauses removal proceedings for someone in the U.S., often granted to those who would have qualified for asylum but missed the filing deadline. It allows you to renew a yearly work permit, but bars you from leaving the country: if you depart, you cannot re-enter.

What are the common grounds for deportation?

Grounds vary by status. A non-resident may be picked up by ICE for entering without permission or overstaying a visa. Permanent residents can also face removal, most often after certain criminal convictions. Crimes substantially raise the risk in either case.

What are the requirements for cancellation of removal?

For LPRs: 7 years total residency in the U.S. and 5 years as a lawful permanent resident before the triggering incident. You file the application with the court; the judge decides at the merits / individual hearing. Witnesses and supporting documents help, if the equities outweigh the negatives, the judge can grant the cancellation.
