Introduction

The Immigrant Investor Program, est. 1990.

USCIS administers the Immigrant Investor Program, known as EB-5, created by Congress to stimulate the U.S. economy through job creation and capital investment by foreign investors. A pilot program first enacted in 1992 also sets aside EB-5 visas for investors in Regional Centers designated by USCIS.

New Commercial Enterprise

What qualifies as a NCE.

Every EB-5 investor must invest in a new commercial enterprise, one established after Nov. 29, 1990 or established on or before that date and either:

  • Purchased and restructured/reorganized into a new enterprise, or
  • Expanded so net worth or employees increase by at least 40%

A commercial enterprise is any for-profit activity formed for the ongoing conduct of lawful business, including:

  • Sole proprietorship
  • Partnership (limited or general)
  • Holding company
  • Joint venture
  • Corporation
  • Business trust or other entity

Note: this does not include noncommercial activity, such as owning a personal residence.

Capital Investment

Two minimums, where you invest matters.

Capital includes cash, equipment, inventory, other tangible property, and cash equivalents, valued at fair market value in U.S. dollars. Capital acquired by unlawful means does not qualify, and investment capital cannot be borrowed.

For investments in a rural area or an area with unemployment of at least 150% of the national average.

Job Creation

10 full-time jobs for qualifying U.S. workers.

Created or preserved within two years of admission as a Conditional Permanent Resident (or, in some cases, a reasonable time after). Full-time means a position of at least 35 hours per week.

Direct Jobs

Identifiable jobs for qualified employees inside the enterprise the EB-5 investor funded directly.

Indirect Jobs

Jobs created collaterally through Regional Center investments. Only available when affiliated with a Regional Center.

Note: A "qualified employee" is a U.S. citizen, LPR, or other work-authorized immigrant, not the investor, the investor's spouse or children, or any nonimmigrant visa holder.

Regional Centers

Pre-approved EB-5 vehicles , no need to build a business yourself.

Regional Centers are pre-approved entities that handle the structure and operations for an immigrant investor who doesn't want to launch their own business. E-2 Treaty Investor

For nationals of countries with a qualifying treaty with the United States. Typically faster to obtain, most E-2 investors put up $200K–$300K and hire four or five workers. Does not grant permanent residency.

EB-5 vs E-2
